1.) Object of the online contract and its definition.

The contract entered into between Idea Pioggia Srl and the Customer is considered concluded with the acceptance, even partial, of the order by Idea Pioggia Srl. This acceptance is deemed implicit if not communicated otherwise to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided during the purchase process and fully accepts the general and payment conditions outlined below. Any right of the Customer to compensation or indemnity is excluded, as well as any contractual or extra-contractual liability for direct or indirect damages to persons and/or property caused by the non-acceptance, even partial, of an order. The online sales contract refers to the distance contract, namely the legal transaction concerning movable goods and/or services concluded between a supplier, Idea Pioggia Srl with registered office at 80143 Centro direzionale ISOLA G7, and a consumer customer within a system of organized distance selling by the supplier, which, for this contract, exclusively uses the communication technology called the internet. All contracts, therefore, will be concluded directly through the consumer customer’s access to the website corresponding to the address www.ideapioggia.it, where, following the indicated procedures, they will conclude the contract for the purchase of the goods. A consumer is understood to be a natural person who purchases goods and services for purposes not directly referable to any professional activity carried out. Below are the sales conditions that will remain effective until modified by the supplier. Any changes to the sales conditions will be effective from the moment they are published on the website www.ideapioggia.it and will refer to sales made from that moment onwards.

2.) Sales prices and purchase methods.

The Customer can only purchase products listed in the electronic catalog of www.ideapioggia.it at the time of placing the order and viewable online at the address (URL) www.ideapioggia.it, as described in their respective information sheets. It is understood that the image accompanying the descriptive sheet of a product may not be perfectly representative of its characteristics but may differ in color, size, etc. All selling prices of the products displayed and indicated on the website www.ideapioggia.it, for which they constitute a public offer under Article 1336 of the Civil Code, are intended excluding VAT and any other tax; the cost of transport is at the expense of the recipient in the absence of different agreements; in the case of delivery abroad, any additional costs due to taxes or duties provided by the legislation in force in the destination country will be borne by the consumer. The purchase contract is perfected by the exact compilation and consent to the purchase expressed through online adherence. The customer can pay for the ordered goods using the payment methods indicated online at the time of purchase. The minimum order is € 700.00.

3.) Execution of the contract and delivery methods.

Idea Pioggia Srl will deliver the selected and ordered products to customers, as described in the previous article, by couriers and/or trusted shippers. In case of absence of the recipient at the time of delivery, a notice will be left, and the customer must personally contact the courier or shipper as soon as possible to agree on the delivery methods. Delivery times, which will never exceed those provided for by Legislative Decree 206/05 (30 days from the order date), can vary from the same day of the order to a maximum of seven working days. These delivery times refer to products in stock at the time of the order. The delivery will be made by carriers mainly at street level. However, no responsibility can be attributed to the supplier for delayed or non-delivery due to force majeure or fortuitous events.

4.) Availability of products.

The customer can purchase the products indicated in the electronic catalog prepared (available on the website www.ideapioggia.it) and in the quantities available in stock. If an order were to exceed the quantity existing in the warehouse, the computer system will still accept the purchase order; it will then be the responsibility of our staff to contact the customer to provide the waiting times for replenishing the products missing in stock. Please note that after the orders have been placed, they cannot be modified or canceled by the customer. In case of an error, please report it within 24 hours of the order to info@ideapioggia.it, making the necessary changes.

5.) Liability.

Idea Pioggia Srl assumes no responsibility for malfunctions attributable to force majeure such as accidents, explosions, fires, strikes, and/or lockouts, earthquakes, floods, and other similar events that prevent, in whole or in part, the timely execution of the contract. The Idea Pioggia. Idea Pioggia Srl will not be liable to any party for damages, losses, and costs incurred as a result of the non-execution of the contract due to the aforementioned causes, with the consumer having the right only to the refund of the amount paid.

6.) Guarantees and assistance methods.

Idea Pioggia Srl sells high-quality products, for which it offers a warranty regarding diamonds and precious stones and their nature, using a group of expert gemologists registered in the register, and this warranty will be accompanied by photos of the object and a detailed description.

7.) Buyer’s obligations.

The consumer undertakes, once the online purchase procedure is completed, to print and keep these general conditions, which, moreover, they will have already read and accepted as a mandatory step in the purchase, as well as the specifications of the product subject to purchase, in order to fully satisfy the condition of Legislative Decree 206/05. The buyer is strictly prohibited from entering false and/or invented and/or fantasy data in the registration procedure necessary to activate the procedure for executing this contract and the related further communications; personal data and email must be exclusively their own real personal data and not those of third parties, or fantasy. It is expressly forbidden to make double registrations corresponding to a single person or enter third-party data. Idea Pioggia Srl reserves the right to legally pursue every violation and abuse, in the interest and for the protection of all consumers.

8.) Right of withdrawal.

The consumer who, for any reason, is not satisfied with the purchase made, has the right to withdraw from the contract entered into, without any penalty and without specifying the reason, within the period of 10 working days from the day of receipt of the goods, for goods, and from the day of the conclusion of the online contract for services. The withdrawal must be communicated by sending, within the aforementioned period of 10 days, a registered letter with return receipt to the following address Idea Pioggia Srl with registered office at 80143 Centro direzionale ISOLA G7. Within the same term, a telegram or a fax can be sent, followed within 48 hours by the aforementioned registered letter with acknowledgment of receipt confirming the stated withdrawal. The customer cannot exercise this right for products packaged to measure or clearly personalized or that, by their nature, cannot be returned or risk deteriorating or altering quickly. Within the aforementioned term of 10 days, all purchased goods must be returned to the sender-supplier intact and in their original packaging and any manuals, without any lack. The return costs will be borne by the customer. Idea Pioggia Srl. will forward the entire amount paid by the consumer within 14 days from the date of shipment of the goods by the customer, except for any restoration costs for damages ascertained to the goods. It is the responsibility of the consumer to promptly provide the bank details on which to receive the transfer (ABI, CAB, current account of the invoice holder).

9.) Contractual resolution and express termination clause.

Idea Pioggia Srl has the right to terminate the contract entered into by giving simple communication to the customer with adequate and justified reasons; in this case, the customer will be entitled exclusively to the return of any amount already paid. The obligations assumed by the customer under Article 7 (Buyer’s obligations), as well as the guarantee of the successful payment that the customer makes with the means referred to in Article 2, are essential, so that by express agreement, the non-fulfillment by the Customer of only one of these obligations will determine the automatic termination of the contract under Article 1456 of the Civil Code, without the need for a judicial decision, without prejudice to the right of Idea Pioggia Srl to take legal action for compensation for any further damage. The customer has the option to cancel the contract within 24 hours of receiving the confirmation email by promptly notifying customer service via email at info@ideapioggia.it.

10.) Jurisdiction and competent court.

Any dispute relating to the application, execution, interpretation, and violation of contracts of purchase made online through the website www.ideapioggia.it is subject to Italian jurisdiction; these general conditions refer, for what is not expressly provided for therein, to the combined provisions of Legislative Decree No. 50 of 15.1.1992 and Legislative Decree 206/05. For any dispute between the parties regarding this contract, the Court of Naples shall have jurisdiction.
